The rules governing your use of Forkast’s website, newsletters, and editorial content.

1. Acceptance of Terms

By accessing forkast.news, subscribing to any Forkast newsletter, or otherwise using our services (collectively, the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

We may revise these Terms at any time. Material changes will be posted on this page and noted on our homepage or in a newsletter. Your continued use after changes take effect constitutes acceptance.

2. What Forkast Is

Forkast publishes news, analysis, and commentary on artificial intelligence policy, regulation, and markets. Our coverage includes original reporting, policy analysis, regulatory tracking, and expert commentary. The Service includes:

  • forkast.news — our website and all published content
  • Newsletters — email-delivered content you subscribe to
  • Any future products or services we offer under the Forkast name

3. Editorial Content Disclaimers

Forkast publishes journalism, not financial or investment advice.

Our coverage of AI markets, cryptocurrency, regulation, and related topics is editorial in nature. It includes reporting, analysis, and opinion. Nothing published by Forkast constitutes financial advice, investment advice, trading advice, or any other professional advice. You should not make financial, investment, or legal decisions based solely on our content without consulting a qualified professional.

Specifically:

  • Analysis and opinion pieces reflect the author’s interpretation of publicly available information. They are labeled as analysis or opinion where applicable.
  • Market coverage reports on events and trends. It does not recommend buying, selling, or holding any asset.
  • Regulatory coverage explains policy developments and their implications. It does not constitute legal advice.
  • Source citations and links to government documents, research papers, or third-party analyses are provided for reader convenience. We are not responsible for the accuracy or content of external sources.

4. Permitted and Prohibited Use

You May

You May Not

  • Reproduce, republish, or redistribute full articles or substantial portions without written permission
  • Use automated systems (bots, scrapers, crawlers) to access or copy the Service without our express written consent
  • Frame, mirror, or embed our content on another site in a way that misrepresents its source
  • Interfere with the Service, its servers, or its networks

  • Impersonate Forkast, its staff, or its contributors

We reserve the right to block access from sources that violate these terms, including automated scrapers and abusive IP ranges.

5. Newsletter Terms

When you subscribe to a Forkast newsletter:

  • Delivery: We will send the newsletter to the email address you provide at the frequency described at the point of subscription.
  • Unsubscribe: Every newsletter includes an unsubscribe link. Unsubscribe requests are processed immediately, though you may receive one additional email due to processing lag.
  • Email practices: We do not sell or share subscriber email addresses with third parties for their marketing purposes. See our Privacy Policy for details on how we handle your data.
  • Content changes: We may modify newsletter content, format, or frequency. Material changes will be communicated in the newsletter itself.

6. User-Generated Content

If we offer comment sections, discussion forums, or other interactive features:

  • Your responsibility: You are solely responsible for any content you post. Do not post content that is defamatory, infringing, unlawful, or harmful.
  • Our license: By posting content on the Service, you grant Forkast a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content in connection with operating the Service.
  • Moderation: We reserve the right to remove any user-generated content at our sole discretion, without notice or explanation.
  • No obligation to host: We are not obligated to provide or maintain any interactive features and may disable them at any time.

7. Intellectual Property

All original content on the Service — including articles, analysis, graphics, logos, illustrations, and design elements — is owned by Forkast or its licensors and protected by applicable copyright, trademark, and other intellectual property laws.

Fair use: We support and respect fair use. Brief quotation with attribution and a link to the source is permitted and encouraged. Wholesale reproduction is not.

Forkast trademarks: The Forkast name, logo, and any associated marks may not be used without written permission.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORKAST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the above, we do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Content is accurate, complete, or current (though we strive for all three)
  • The Service will meet your specific requirements
  • Defects will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORKAST AND ITS CONTRIBUTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow limitations on implied warranties or liability for certain damages. In those jurisdictions, the above limitations apply to the fullest extent permitted.

10. Indemnification

You agree to indemnify and hold harmless Forkast and its officers, employees, and agents from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms.

11. Third-Party Links and Content

Our articles link to government documents, regulatory filings, academic papers, corporate announcements, and other external sources. These links are provided for reference and context. We do not control, endorse, or assume responsibility for any third-party content, and your use of linked sites is at your own risk.

12. Privacy

13. DMCA and Copyright Complaints

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to jurisdiction in those courts.

15. Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.

16. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
